Terms & Conditions

These terms govern the live auction at auction.davesharp.art (“the auction”), run by Dave Sharp (“we”, “us”). By registering and placing a bid you agree to them, so please read them before you bid.

1. Registration and eligibility

To bid you must register with your name and a valid email address (a phone number is optional) and verify your email using the one-time code we send you. You must be 18 or over and able to enter into a binding contract. We may decline or remove a registration at our reasonable discretion.

2. The auction

The auction is a live ascending auction for a single original painting, described on the auction page. It runs between the published opening and closing times. The painting is an original, one-of-a-kind work by Dave Sharp, signed by the artist, and is described in good faith — colours and detail may vary slightly from how images appear on your screen.

3. Bidding

Bidding is open only while the auction is live. Each bid must be at least one minimum increment above the current bid, and no bid may exceed the published maximum bid.

Every bid is binding. Placing a bid is a commitment to buy the painting at that amount if you are the highest bidder when the auction closes. Bids cannot be changed or withdrawn once placed.

4. Closing and anti-snipe

The auction closes at the published time, except that any bid placed in the final 10 minutes extends the closing time by a further 10 minutes. This repeats until a 10-minute period passes with no further bids. The highest valid bid at the moment the auction closes wins.

5. Payment

The winning bidder is notified by email and sent an invoice. Payment in full is due within 24 hours of that invoice. If payment is not received within 24 hours, we may treat the bid as withdrawn and offer the painting to the next-highest bidder, who is then subject to the same terms — and so on, if necessary.

6. Delivery

The winning bid is for the painting only. Delivery or collection is arranged separately with the buyer after payment and is at the buyer’s cost. We will help arrange suitable delivery, but the cost of shipping, packing and any insurance is the buyer’s responsibility.

7. Our rights

We may, at our reasonable discretion, decline or cancel a registration, void a bid, remove a bidder, or correct an obvious error in a bid or in the auction listing. We may also extend, pause or, in exceptional circumstances, withdraw the auction. We would only do these things where it is necessary — for example where we suspect fraud, bid manipulation, non-payment, or a breach of these terms.

8. Technical issues

The auction runs online and depends on systems and connections outside our control. We are not responsible for a bid that fails to reach us, or for a bidder being unable to bid, because of an interruption to the internet, a device, or a third-party service. Nothing in these terms limits our liability where it cannot be limited by law.

9. Your information

We handle the personal information you give us in line with our Privacy Policy.

10. Governing law

These terms, and any auction conducted under them, are governed by the laws of England and Wales and subject to the courts of England and Wales.
